PUBLIC CONSULTATION - COMMUNITY LAND MANAGEMENT PLAN (CLMP)

The Peterborough Miniature Railway Association (PMRA) is looking to establish a miniature railway on Council owned and Crown land located at Section 484, 486 and A93 Telford Avenue Peterborough (opposite Steamtown and next to the Nissen Hut & Dog Park).

Council proposes to grant a lease to the PMRA for this purpose for a term of 10 years, with an option to renew for a further 10 years. Public consultation regarding the proposed lease to the PMRA was initially undertaken in June 2019.

Section 486 in the Hundred of Yongala is Crown land, under the care, control and management of Council, and is classified as community land under section 193 of the Local Government Act 1999. The Council is required to prepare and adopt a Community Land Management Plan for community land if the land is, or is to be, occupied under a lease or licence.

Sections 484 and A93 are not classified as community land and so no Community Land Management Plan is required for them.

Under section 197 of the Local Government Act 1999 Council is required to consult with the community when establishing a Community Land Management Plan.

Under section 202(2) of the Local Government Act 1999 Council is required to consult with the community before granting a lease over community land.
